1. Acceptance of Terms

By accessing and using MagicDM (the "Service"), developed and operated by Digidevs, you accept and agree to be bound by the terms and provision of this agreement.

If you do not agree to abide by these Terms of Service, you are not authorized to use or access the Service.

2. Description of Service

MagicDM provides a software-as-a-service (SaaS) platform that allows users to automate direct messages, comment replies, and story replies on their connected Instagram accounts using the official Meta Graph API.

3. Meta and Instagram Compliance

MagicDM is an independent application and is not affiliated with, sponsored, or endorsed by Meta Platforms, Inc. or Instagram.

• You agree to use MagicDM in strict compliance with the Instagram Community Guidelines and the Meta Platform Terms.
• You are solely responsible for the content of the automated messages sent through your account.
• Anti-Spam Policy: You may not use MagicDM to send unsolicited spam, malicious links, or harassing content. Violation of this rule may result in immediate termination of your MagicDM account and potential action by Meta against your Instagram account.
• We are not liable for any account restrictions, shadowbans, or permanent bans imposed by Instagram due to your misuse of automation or violation of their platform rules.

4. User Accounts

To use MagicDM, you must register for an account and connect an eligible Instagram Creator or Business account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.

You agree to accept responsibility for all activities that occur under your account or password.

5. Subscriptions and Payments

Some features of MagicDM are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (such as monthly or annually).

Payments are processed securely via our third-party payment gateways (e.g., Stripe, Razorpay). We do not store your full credit card information on our servers. You may cancel your subscription at any time, but no refunds will be provided for partial subscription periods unless legally required.

6. Limitation of Liability

In no event shall Digidevs, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any unauthorized access, use or alteration of your transmissions or content.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, specifically under the jurisdiction of the courts in Bihar, without regard to its conflict of law provisions.
